Legal Declarations

Skills Currency

I understand that I may not exercise the full privileges of any pilot certificate I hold unless I comply with the currency requirements of the OPM. That is I have flown at least 2 hours airtime or at least 10 flights on the aircraft type in the last year OR I will demonstrate the required skills for the certificates I hold to a person approved by the Association ( Instructor, PG3 or Adv rated pilot) before exercising the privileges of those certificates.

Waiver

I acknowledge that there is an inherent risk in participating in the sport of hang gliding and paragliding. I willingly accept all the risks of hang gliding and or paragliding, including without limitation the risks and the possibility of personal injury, death, property damage or loss resulting there from for any reason. I acknowledge that the enjoyment and excitement of hang gliding and or paragliding is derived in part from the freedom of flight and that. the inherent risks of flying contribute to such enjoyment and excitement.

The NZHGPA is not liable for any financial loss, travel plans, damage, physical or mental injury of a pilot member. This exclusion is subject to any rights or remedies a customer has under the Consumer Guarantees Act 1993, or any other New Zealand law.

I consent to the collection and retention of membership details by the NZHGPA for record-keeping purposes, for the Association to disclose my details to a member’s club, and for my name, membership number and certificate to be published on the Association’s website to enable CAA inspectors and landowners to confirm my flying privileges, and relevant details to be provided to CAA for accident investigations. I acknowledge my right to access and correct this information. This consent is given in accordance with the Privacy Act 2020

Medical Declaration 1.

I hereby declare that I do not suffer from any of the following specific conditions.

  • a)      Epilepsy or other periodic disturbance of consciousness, giddiness, panic or anxiety attacks, motion sickness, neurological disorders or history of severe head injury.
  • b)     Diabetes requiring insulin therapy.
  • c)      Heart condition, high or low blood pressure, chest pains or Angina Pectoris or any form of heart disease.
  • d)     Episodes of shortness of breath or lung disease.
  • e)      Chronic ear or sinus disease.
  • f)      Psychiatric disorder.
  • g)     A history of alcoholism or drug addiction.
  • h)    Any condition requiring regular medication with antihistamines, antihistaminics, antispasmodics, sedatives or narcotics.
  • i)       Physical impairment, recent sprains or muscular injuries, dislocations, bone disorders, fragile skin, prosthetics or known disability.
  • j)       Pregnancy.

I also declare that; I do not have any established history of or currently suffer from any other medical condition, disease  or disability, either physical or mental health or serious behavioral problems, any visual defect, or take any medication, which would be likely to affect my ability to fly a glider safely.

 I understand that it is my responsibility to inform within 14 days the NZHGPA Administrator in confidence by email at; admin@nzhgpa.org.nz or letter, of any changes occurring which would affect my Medical Examiner Certificate declaration.

    OR Medical Declaration 2.

    I have previously declared a condition to the NZHGPA and to the best of my knowledge this condition is stable with no change that would affect my ability to fly a glider safely since I last provided a Medical Examiners Certificate. 

    I understand that it is my responsibility to inform within 14 days the NZHGPA Administrator in confidence by email at; admin@nzhgpa.org.nz or letter, of any changes occurring which would affect my Medical Examiner Certificate declaration

     

    Fit & Proper Person Declaration

    I hereby declare that since I last applied for membership to the NZHGPA:

    1. I have not been convicted in any court of law of any transport safety offence or are presently facing charges for a transport safety offence.
    2. I have not been convicted of any criminal charge or presently face charges for any criminal offence.
    3. I have not developed a history of physical or mental illness or serious behavioural problems. 
    4. I have not, in any country, been the holder of an aviation document which has been suspended or revoked (other than a licence that has been superseded by a replacement or a higher licence)?

    I understand that it is my responsibility to inform the NZHGPA and the Civil Aviation Authority New Zealand of any changes occurring which may affect this declaration.

    Core Principles and Behaviours

     Members engaging in flying activities shall, at a minimum:
    Respect the rights, dignity, worth and privacy of others.

    1. Be fair, considerate, and honest in dealings with all NZHGPA members, officials, administrators and the general public.
    2. Avoid bullying, harassment or discriminating behaviour toward others.
    3. Display a positive attitude to flight safety, and encourage this in others.
    4. Encourage and assist others to develop good attitudes, skills and knowledge.
    5. Sell only safe and serviceable equipment that is suitable to the buyer in terms of safety, ability and use.
    6. Maintain familiarity with the NZHGPA Operations and Procedures Manual and Constitution, to ensure compliance with the regulations as required by law. This includes only engaging in activities for which they are qualified and competent.
    7. Avoid flying if they are impaired for any reason, whether due to lifestyle factor, legal or illegal substance.
    8. Create a sporting environment free of unlawful activity, e.g. drugs and violence

    Country Code

    We are all dependent on good relations with the farmers and public bodies who own the land where we fly. 

    Here are some guidelines to help ensure that you and other pilots will be able to continue to fly:

    • ALWAYS CHECK with local pilots before flying at new sites.
    • ALWAYS ASK PERMISSION to fly unless you are absolutely certain that the owner allows use of the site without asking.
    • CHECK AGAIN at springtime as most farms have pregnant and newborn stock that can easily be frightened and injured.
    • DO NOT show displeasure or abuse an owner if permission is refused. This could hamper getting permission in the future.
    • ALWAYS GET PERMISSION to take a vehicle onto a property. Ensure that vehicles without gliders are not taken onto the property. Put all gliders on one car rather than have a convoy crossing the property. If stock is nearby, drive slowly.
    • LEAVE GATES as you find them. Gates may be closed to keep stock in or open to allow stock to feed. Ensure that all pilots and drivers understand.
    • USE STILES and gates where ever possible. If you need to cross a fence, cross at a post or strainer post.
    • AVOID hay, standing or cut, unless permission has been given to cross it.
    • AVOID landing in paddocks containing crops or stock. Carefully move off crops to avoid damage.
    • DO NOT LIGHT FIRES at any time.
    • DO NOT TAKE DOGS on to farms or property.
    • DO NOT SMOKE during fire risk times.
    • DO NOT disturb plants or machinery; move around it.
    • LEAVE NO RUBBISH.
